These Terms of Service (“Terms”) govern your use of the website and services provided by Ability Culinary, LLC (“ABLTY,” “we,” “us,” or “our”), located in Washington, DC. By accessing our website or placing an order, you agree to be bound by these Terms.

Certain features of our website require an account. Accounts are created through an approval process or via team access codes provided by your organization.
All payments are processed securely through Stripe. By placing an order, you authorize us to charge your selected payment method for the total order amount, including applicable shipping fees and taxes.
Important: It is your responsibility to review all ingredients and verify that your order meets your dietary needs and restrictions.
All content on our website — including text, images, logos, recipes, and branding — is the property of Ability Culinary, LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
To the maximum extent permitted by law, Ability Culinary, LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services, including but not limited to:
Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid for the specific order giving rise to the claim.
You agree to indemnify and hold harmless Ability Culinary, LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of our services.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall be resolved through the following process:
Before initiating any formal proceedings, you agree to contact us at hello@ablty.com and attempt to resolve the dispute informally for at least 30 days.
If we cannot resolve the dispute informally, either party may elect to have the dispute resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Washington, DC. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Ability Culinary, LLC.
Either party may bring claims in small claims court in Washington, DC if the claim qualifies. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for matters related to intellectual property or unauthorized access to our services.
These Terms are governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
