These Terms of Service (“Terms”) govern your use of the website and services provided by Ability Culinary, LLC (“ABLTY,” “we,” “us,” or “our”), located in Washington, DC. By accessing our website or placing an order, you agree to be bound by these Terms.
1. Services
ABLTY provides performance nutrition and culinary services, including but not limited to:
- Online ordering of menu items for team and corporate accounts
- Direct-to-consumer sales of packaged food products via our online shop
- Delivery of food orders within the Washington, DC, Maryland, and Virginia (DMV) metropolitan area
- Team and corporate meal programs with customizable menus
2. Accounts and Access
Certain features of our website require an account. Accounts are created through an approval process or via team access codes provided by your organization.
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- Team access codes are confidential and should only be shared within your organization
- We reserve the right to suspend or terminate accounts that violate these Terms
3. Orders and Pricing
- All orders are subject to availability and confirmation by ABLTY
- Prices are subject to change without notice. The price at the time of your order confirmation applies
- We reserve the right to refuse or cancel any order at our discretion, including orders suspected of fraud or error
- Menu item pricing may vary based on your team or organization tier
4. Promo Codes and Discounts
- Promo codes are subject to specific terms, including expiration dates and usage limits
- Promo codes cannot be combined unless explicitly stated
- We reserve the right to void promo codes that are used in violation of their terms or obtained through unauthorized means
- Discounts are applied at checkout and reflected in the final order total
5. Payment
All payments are processed securely through Stripe. By placing an order, you authorize us to charge your selected payment method for the total order amount, including applicable shipping fees and taxes.
- We accept major credit cards, debit cards, Apple Pay, Google Pay, and Link
- Payment is collected at the time of order confirmation for all order types
- If you modify an order before the modification cutoff, price differences are automatically charged or refunded to your original payment method
- All prices are listed in US dollars
- You agree that all payment information you provide is accurate and complete
6. Delivery
- We deliver within the Washington, DC, Maryland, and Virginia (DMV) metropolitan area
- Delivery times are provided as estimates and are best-effort — we do not guarantee specific delivery times
- You are responsible for providing accurate delivery information
- Shipping fees (standard and cold pack) are calculated at checkout based on your order contents
- Online shop orders over $175 qualify for free shipping on both standard and cold pack methods
- Orders containing frozen items require cold pack shipping and are shipped Monday through Wednesday only
- We are not responsible for delays caused by weather, traffic, or other circumstances beyond our control
7. Food Allergies and Dietary Information
Important: It is your responsibility to review all ingredients and verify that your order meets your dietary needs and restrictions.
- While we make every effort to accommodate dietary restrictions and accurately label allergens, our kitchen handles a wide range of ingredients including common allergens (nuts, dairy, gluten, shellfish, soy, eggs, and others)
- Cross-contamination is possible despite our best precautions
- If you have a severe food allergy, please contact us directly at hello@ablty.com before placing your order
- ABLTY is not liable for allergic reactions or adverse health effects resulting from the consumption of our products
8. Cancellations and Refunds
- Team orders may be modified up to 72 hours before the scheduled delivery date, provided the order has not entered preparation. Price differences from modifications are automatically charged or refunded to your original payment method
- Refund requests are handled on a case-by-case basis
- We reserve the right to issue refunds in the form of account credit
- Perishable items cannot be returned
9. Intellectual Property
All content on our website — including text, images, logos, recipes, and branding — is the property of Ability Culinary, LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
10. Limitation of Liability
To the maximum extent permitted by law, Ability Culinary, LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services, including but not limited to:
- Allergic reactions or adverse health effects from consuming our products
- Delivery delays or failures
- Errors in order processing
- Loss of data or unauthorized access to your account
- Service interruptions or website unavailability
Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid for the specific order giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Ability Culinary, LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of our services.
12. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall be resolved through the following process:
Informal Resolution
Before initiating any formal proceedings, you agree to contact us at hello@ablty.com and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration
If we cannot resolve the dispute informally, either party may elect to have the dispute resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Washington, DC. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Ability Culinary, LLC.
Exceptions
Either party may bring claims in small claims court in Washington, DC if the claim qualifies. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for matters related to intellectual property or unauthorized access to our services.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
